Welcome to Scalable Route. These Terms & Conditions ("Terms") govern your access to and use of scalableroute.com and any related content, forms, funnels, calls, and services (together, the "Services") provided by Scalable Route LLC ("Scalable Route," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Who We Are
Scalable Route LLC is a growth marketing agency that helps creators and coaches launch and scale offers through paid advertising, funnels, copywriting, sales infrastructure, and marketing automation. Scalable Route LLC operates as a business separate and distinct from any other entity, and these Terms apply only to Scalable Route LLC.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and complete.
3. Client Engagements and Governing Agreement
These Terms govern general use of our website and interactions with our Services, such as browsing, booking a call, or opting in to our content.
Any paid engagement between you and Scalable Route is governed by a separate written services agreement (for example, a Marketing Service Agreement) signed by both parties. If anything in that signed agreement conflicts with these Terms, the signed agreement controls for that engagement. Nothing on our website, in our marketing, or in a discovery call creates a binding service relationship until a written agreement is signed.
4. Booking Calls and Communications
When you book a call or submit a form, you agree to provide accurate information and to attend or reschedule scheduled calls in good faith. By providing your contact details, you consent to be contacted by email, phone, and SMS regarding your inquiry and our Services, consistent with our Privacy Policy. You can opt out of marketing messages at any time.
5. No Guarantee of Results
Our Services relate to marketing, advertising, and sales performance, which depend on many factors outside our control, including your offer, pricing, audience, market conditions, ad platform policies, and your own execution and responsiveness.
Any examples, case studies, testimonials, revenue figures, or results we share are illustrative and are not a promise or guarantee that you will achieve the same or similar results. We do not guarantee any specific outcome, revenue, return on ad spend, lead volume, or sales. You are solely responsible for your own business decisions and results.
6. Advertising Spend and Third-Party Platforms
Where an engagement involves paid advertising, you are responsible for funding your own advertising accounts and any associated platform costs unless your signed agreement states otherwise. We do not control third-party platforms such as Meta, Google, or others, and we are not responsible for their decisions, including account restrictions, ad rejections, policy changes, price changes, or downtime. Your use of any third-party platform or tool is subject to that provider's own terms.
7. Fees and Payment
Fees for paid engagements, including any onboarding fees, retainers, or revenue-share arrangements, are set out in your signed services agreement. Unless otherwise stated in that agreement, fees are non-refundable, are due on the dates specified, and may be subject to late fees or suspension of work if unpaid. You are responsible for any taxes associated with the Services other than taxes on our net income.
8. Client Responsibilities
To deliver the Services effectively, we may rely on you to provide timely access, approvals, assets, information, and funding. You agree to cooperate reasonably, respond within reasonable timeframes, and ensure that any materials you provide are accurate and do not infringe the rights of others. Delays or failures on your side may affect timelines and results, and are not our responsibility.
9. Intellectual Property
All content on our website, including text, graphics, logos, frameworks, and materials, is owned by Scalable Route or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, resell, or distribute our content without our prior written permission.
Ownership of deliverables created during a paid engagement, such as funnels, ad creative, and copy, is addressed in your signed services agreement. Absent a signed agreement stating otherwise, we retain ownership of our proprietary methods, templates, and systems, and grant you a license to use the specific deliverables we create for you.
10. Testimonials and Publicity
With your consent where required, we may reference your business name, logo, and results as a case study or testimonial in our marketing. If you prefer we not do so, you can let us know in writing and we will honor that request going forward.
11. Confidentiality
Each party agrees to protect the other party's confidential information and to use it only for purposes of the engagement. This obligation does not apply to information that is public, already known, independently developed, or required to be disclosed by law.
12. Acceptable Use
You agree not to use the Services to:
i. Violate any law or regulation, or infringe the rights of others;
ii. Provide false, misleading, or fraudulent information;
iii. Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
iv. Copy, scrape, or misuse our content or systems; or
v. Use the Services in a way that could harm Scalable Route, our clients, or any third party.
We may suspend or terminate access to the Services for any violation of these Terms.
13. Disclaimers
The Services and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any particular result will be achieved.
14. Limitation of Liability
To the fullest extent permitted by law, Scalable Route and its owners, team members, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to the Services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Services will not exceed the amount you paid to us for the specific Services giving rise to the claim in the three months preceding the event, or one hundred U.S. dollars ($100) if you have not paid us anything.
15. Indemnification
You agree to indemnify and hold harmless Scalable Route and its owners, team members, and contractors from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising out of your use of the Services, your breach of these Terms, your business or offers, or your violation of any law or the rights of any third party.
16. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the website or Services at our discretion, including for violation of these Terms. Termination of a paid engagement is governed by your signed services agreement. Provisions that by their nature should survive termination, including intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification, will survive.
17. Third-Party Links
Our Services may link to third-party websites or tools we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved in the courts or through the dispute resolution process specified in your signed services agreement, or, absent such an agreement, in the state or federal courts located in Wyoming
20. Miscellaneous
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with any signed services agreement and our Privacy Policy, make up the entire agreement between you and Scalable Route regarding the Services.
